    Terms of Trade

    Payment Terms & Conditions of Sale

    These Terms and Conditions apply to all quotes, orders, and installations performed by CCW & Co Pty Ltd trading as Domain Flooring (ABN: 80646443316). Acceptance of a quote constitutes acceptance of these Terms and Conditions in full.

    1. PAYMENT TERMS

    • 1.1 Deposit
      A deposit of fifty percent (50%) of the total quoted price is required to confirm and secure your order. Work will not be scheduled until the deposit is received.
    • 1.2 Balance Payment
      The remaining balance of fifty percent (50%) is due no later than three (3) business days prior to the scheduled installation or delivery date, unless an alternative arrangement has been agreed in writing with management of Domain Flooring.
    • 1.3 Goods Held in Stock
      Where goods are held in stock for more than twenty (20) days pending the customer taking delivery, the full balance (less labour) becomes payable immediately.

    2. PAYMENT METHOD

    • 2.1 Accepted Payment Methods
      Domain Flooring accepts payment by the following methods:
      (a) Cash
      (b) Direct bank transfer (EFT)
      (c) Credit or debit card — Visa, Mastercard, and American Express
    • 2.2 Credit Card Surcharge
      All credit and debit card payments will incur a surcharge of 1.1% (inclusive of GST). This surcharge is non-negotiable and reflects the merchant fee charged to Domain Flooring.
    • 2.3 Direct Deposit Reference
      For all direct deposit (EFT) payments, the customer must use their quote number (located at the top right of the quote) as the payment reference. Payments made without a reference may cause delays in allocation.
    • 2.4 Bank Account Details
      Direct deposit is payable to Account Name: CCW & Co Pty Ltd (Domain Flooring)Please call the Domain Flooring office on 03 9569 2564 to verify the account details are correct before transferring any funds.
    • 2.5 Customer Responsibility for Payment
      It is the customer's sole responsibility to ensure payment is made to the correct account as listed above. Any payment made to an account other than the nominated account stated in clause 2.4 will be deemed a non-payment. CCW & Co Pty Ltd (Domain Flooring) accepts no liability for any financial loss arising from payment made to an incorrect account.
    • 2.6 GST
      Unless otherwise stated, all quoted prices are inclusive of Goods and Services Tax (GST) as required under Australian law.

    3. LATE PAYMENTS & OVERDUE ACCOUNTS

    • 3.1 Non-Account Holders — Withheld Installation
      For customers without a trading account, installation will not commence if full payment of the balance has not been received at least three (3) business days prior to the scheduled installation date.
    • 3.2 Late Payment Surcharge — 30 Days
      Any outstanding invoice amount not paid within thirty (30) days after the due date will incur a late payment surcharge of five percent (5%) of the outstanding balance.
    • 3.3 Debt Recovery — 60 Days
      If any outstanding amount remains unpaid sixty (60) days after the due date, CCW & Co Pty Ltd (Domain Flooring) reserves the right to refer the debt to a third-party collection agency and/or list the customer with a credit reporting body. All costs associated with debt recovery, including collection agency fees and legal costs, will be added to the outstanding balance and remain the responsibility of the customer.
    • 3.4 Retention of Title
      All goods and materials supplied by Domain Flooring remain the property of CCW & Co Pty Ltd until payment is received in full. Domain Flooring reserves the right to recover goods in the event of non-payment.

    4. CANCELLATIONS

    • 4.1 Cancellation After Approval
      If a job is cancelled after the customer has provided written or verbal approval for Domain Flooring to proceed, the customer will be liable for:
      (a) Any costs already incurred by Domain Flooring, including but not limited to stock purchases, freight, and subcontractor fees; and
      (b) An administration fee of $100.00 (inclusive of GST).
    • 4.2 Cancellation Notice
      Cancellations must be notified in writing to Domain Flooring as soon as practicable. Verbal cancellations will not be accepted without written confirmation.

    5. SCOPE OF WORKS & VARIATIONS

    • 5.1 Quoted Scope
      The quote issued by Domain Flooring covers only the works, products, and services expressly described therein. Any additional works identified during or after installation that fall outside the original scope will be quoted separately.
    • 5.2 Variation Approval
      No variation to the agreed scope of works will be carried out without prior written approval from the customer. Domain Flooring will not be liable for delays arising from a customer's failure to approve a variation in a timely manner.
    • 5.3 Subfloor & Site Conditions
      Domain Flooring quotes are based on site conditions as observed at the time of measure and quote. Unforeseen subfloor conditions identified at the time of installation — including but not limited to excessive moisture, unevenness beyond acceptable tolerances, existing adhesive, structural defects, or concealed services — may require additional works. Any such additional works will be communicated to the customer prior to commencement and will be charged accordingly.

    6. SITE READINESS & ACCESS

    • 6.1 Customer Obligations
      The customer is responsible for ensuring the installation site is ready and accessible on the agreed installation date. This includes, but is not limited to:
      (a) Ensuring other trades have completed their works;
      (b) Ensuring the site is clean, dry, and free of debris;
      (c) Ensuring adequate access is available for Domain Flooring's installers and any required equipment.
    • 6.2 Failed Access / Site Not Ready
      If Domain Flooring's installers attend the site on the agreed date and are unable to commence installation due to site conditions or lack of access that are the customer's responsibility, a re-attendance fee will apply. The re-attendance fee will be communicated to the customer prior to rescheduling.

    7. FURNITURE MOVING

    • 7.1 Customer Responsibility
      Unless otherwise agreed in writing, it is the customer's responsibility to ensure all furniture, personal items, and fittings are removed from the installation area prior to the installer's arrival.
    • 7.2 Assistance Provided
      Where Domain Flooring's installers provide assistance with moving furniture as a courtesy, Domain Flooring and its installers accept no liability for any damage to furniture, personal property, or fittings. Fragile, valuable, or antique items should be removed by the customer prior to installation.

    8. GENERAL CONDITIONS

    • 8.1 Acceptance of Terms
      Acceptance of a quote issued by Domain Flooring ('the Company') constitutes acceptance of these Payment Terms and Conditions in full.
    • 8.2 Quote Validity
      Quotes are valid for fourteen (14) days from the date of issue. After that period, the Company is entitled to amend the quote to account for any changes in supplier pricing, freight costs, or other relevant factors.
    • 8.3 Work Completion Dates
      Work completion dates may vary as a result of delays with suppliers, other trades, or government restrictions. In all cases, the Company will endeavour to complete all works within the agreed timeframes and will communicate any delays to the customer as soon as reasonably practicable.
    • 8.4 Third-Party Works
      The Company will not be liable for any default arising from faulty workmanship or materials caused by any other person or company engaged by the customer to perform work or supply materials in connection with the services or to the property.
    • 8.5 Product & Installation Warranties
      All products supplied by Domain Flooring are subject to the relevant manufacturer's warranty. Warranty terms vary between manufacturers and products; customers should refer to the individual product warranty documentation provided. Domain Flooring offers a limited twelve (12) month installation warranty covering defects in the workmanship of installation only. This installation warranty does not cover product defects, faults, or failures, which remain subject to the manufacturer's warranty.
    • 8.6 Retentions
      The Company does not accept any retentions of any kind unless a prior written arrangement has been made with management of the Company.
    • 8.7 Carpet Installation — Wall & Skirting Marks
      Carpet is manufactured in widths of 3.6m or 4.0m and can be difficult to manoeuvre within rooms and around doorways. There is a possibility that skirting boards or walls may sustain minor marks during carpet installation. The Company's installers will take all reasonable care to minimise such occurrences; however, paint touch-ups may occasionally be required after installation. Touch-up painting is not the responsibility of Domain Flooring or its installers.

    9. DISPUTE RESOLUTION

    • 9.1 Notification
      Any dispute, complaint, or claim arising from the works must be notified to Domain Flooring in writing within seven (7) days of the installation completion date. The Company will not be responsible for defects or complaints raised after this period unless the defect could not reasonably have been identified within seven days.
    • 9.2 Resolution Process
      Domain Flooring will endeavour to resolve all disputes promptly and in good faith. In the event that a dispute cannot be resolved directly between the parties, either party may refer the matter to the Victorian Civil and Administrative Tribunal (VCAT) or such other relevant dispute resolution body as may apply.

    10. PRIVACY

    • 10.1 Collection of Personal Information
      Domain Flooring collects personal information (including name, address, contact details, and payment information) for the purpose of providing flooring products and installation services. This information will not be disclosed to third parties except as required to fulfil the agreed services (e.g. subcontractors, freight providers) or as required by law.
    • 10.2 Australian Privacy Act
      Domain Flooring handles personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. For enquiries regarding your personal information, please contact us at sales@domainflooring.com.au.

    11. FORCE MAJEURE

    • 11.1 Events Beyond Control
      Domain Flooring will not be liable for any delay or failure to perform its obligations under these Terms and Conditions where such delay or failure arises from circumstances beyond the Company's reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, epidemic, government-imposed restrictions, supply chain disruptions, industrial action, or failure of third-party suppliers. In such circumstances, Domain Flooring will notify the customer as soon as practicable and will use reasonable endeavours to minimise any delay.

    12. GOVERNING LAW

    • 12.1
      These Terms and Conditions are governed by the laws of the State of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria in relation to any dispute arising under or in connection with these Terms and Conditions.
